Branson Premier Terms of Service

Welcome to Branson Premier. By accessing our platform, booking a reservation, or listing a property, you agree to be bound by these Terms and Conditions. These terms constitute a binding legal agreement between you (“User,” “Guest,” or “Host”) and Branson Premier.

Governing Law: These terms are governed by the laws of the State of Missouri, Taney County, Stone County, and the City of Branson. All disputes shall be resolved exclusively in the courts of the applicable County in Missouri.

PART I: TERMS FOR GUESTS

  1. Booking and Payments
  • Eligibility: Guests must meet the minimum age requirement specified by the Host for each property, which may vary. You agree to provide accurate information regarding the number of guests and the purpose of the stay.
  • Payment: Payment is due at booking per the checkout terms. We accept major credit cards.
  • Cancellations: Cancellation policies vary by property. It is your responsibility to review the Host’s specific policy before booking. Refunds are processed in accordance with the Host’s policy.
  • No-Shows: Failure to check in without notice results in forfeiture of payment.
  1. Property Use and Conduct
  • House Rules: You agree to abide by all specific House Rules (smoking, pets, noise) listed by the Host.
  • Occupancy: Do not exceed the maximum guest count listed. Unauthorized guests may incur fees or be subject to immediate eviction.
  • Safety & Security: You must lock all doors/windows when leaving. Illegal activity, drug use, and disruptive parties are strictly prohibited and constitute grounds for immediate eviction without refund.
  • Check-in/Out: Adhere strictly to confirmed times. Late check-outs without approval may incur fees.
  1. Damages You are financially responsible for any damage caused to the property during your stay. You authorize Branson Premier to charge your payment method for repairs or replacements if the Host reports valid damage within 48 hours of checkout.

PART II: TERMS FOR HOSTS

  1. Listing Accuracy & Standards
  • Integrity: You must accurately represent your property. Photos and descriptions must be current.
  • Safety: Your property must meet all local health, safety, and building codes (including smoke/CO detectors and fire extinguishers) in accordance with the laws of the State of Missouri, Taney County, Stone County, and the City of Branson. You must hold a valid business license/permit as required by local regulations.
  • Cleanliness: You must adhere to high cleaning standards and sanitary protocols between stays.
  1. Host Obligations
  • Inclusivity: Discrimination based on race, religion, gender, or disability is strictly prohibited.
  • PMS Requirement: You must use an approved Property Management System (PMS) that syncs real-time availability, rates, and bookings with Branson Premier.
  • Direct Dealings: You agree not to circumvent the platform. soliciting guests to pay outside Branson Premier is prohibited.
  1. Payouts and Taxes
  • Schedule: Payouts are initiated 24 hours after guest check-in, barring disputes. Processing takes 1-3 business days.
  • Taxes: Branson Premier will always collect all applicable sales taxes on the host’s behalf as required by the State of Missouri, Taney County, Stone County, and the City of Branson. However, Branson Premier may or may not remit these collected taxes directly to the government authorities. If Branson Premier chooses not to remit the taxes directly, the collected sales taxes will be remitted to the Host, and the Host will be solely responsible for the timely remission of such taxes to the appropriate authorities as required by law. You are responsible for income tax reporting (1099s provided annually).
  • Promotions: Participation in sales/coupons is voluntary but binding if you opt in.
  1. Insurance & Liability Branson Premier does not provide insurance. Hosts are required to maintain appropriate short-term rental liability insurance.

PART III: GENERAL POLICIES (ALL USERS)

  1. Privacy & Data We respect your privacy. Personal contact information is shared only between the Host and the Guest upon confirmation of the booking. We do not sell data to third parties.
  • Cameras: Hosts may strictly use exterior security cameras (e.g., front door) but must disclose them. Interior cameras are illegal and strictly prohibited.
  1. Reviews and Feedback
  • External Reviews (Non-Lodging): For local restaurants, attractions, outdoor activities, and shows, users may be directed to external platforms like Yelp and Google Reviews. Branson Premier is not responsible for the content or moderation of reviews on these external sites.
  • Lodging Reviews (Internal System): For property bookings made through Branson Premier, we utilize our own internal review system. Guests are encouraged to leave honest and respectful reviews of their stay.
  • Host Right to Appeal (Pre-Publication): Hosts have the right to appeal a lodging review they believe to be false, inaccurate, or in violation of our content guidelines. Branson Premier will review the appeal and validate the truthfulness of the statements before the review is made public. If a review is found to be false or in violation, it may be edited or withheld from publication.
  • Oversight and Fairness: Branson Premier oversees the internal lodging review system to ensure fairness and adherence to our content guidelines for both Guests and Hosts. Reviews containing false information, personal attacks, or offensive language may be removed or flagged.
  • Responding to Reviews: Hosts may respond to published lodging reviews to provide context or address concerns. Host responses must be professional and respectful.
  1. Dispute Resolution
  • Mediation: Guests and Hosts should attempt to resolve disputes directly. If that fails, Branson Premier may mediate within 14 days of a complaint.
  • Arbitration: Unresolved disputes may be referred to binding arbitration by a neutral third party appointed by Branson Premier.
  1. Indemnification & Limitation of Liability You agree to release, defend, indemnify, and hold Branson Premier harmless from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Platform or your breach of these Terms. Branson Premier is not liable for incidental or consequential damages, property damage, or personal injury resulting from your stay.
  2. Disruptive Events (Force Majeure) In the event of government mandates or natural disasters preventing travel, standard cancellation policies may be waived in favor of rebooking or refunds, determined by Branson Premier’s then-current Major Disruptive Events Policy.
  3. Termination Branson Premier reserves the right to suspend or terminate your account and cancel upcoming reservations for violation of these terms, illegal activity, or strictly at our discretion to protect our community.
